Mobile App End User License Agreement

This agreement covers the UpliftOS mobile application for iPhone, iPad, and Android. It is between you and UpliftOS, and it governs the app on your device. What you do inside the app — your organization's data, your applications, your agents — is governed by our Terms of Service and Privacy Policy, which continue to apply in full.

If you downloaded the app from the Apple App Store, Sections 10 to 18 are the terms Apple requires this agreement to contain. Read them; several of them are about what Apple is not responsible for.

1. What the App Is

The UpliftOS mobile app is a companion to the UpliftOS platform. It is not a standalone product: you need a UpliftOS account and an organization that has given you access. Signing in is how the app gets anything to show you.

The app is free to download. There is no in-app purchase, and no subscription is sold through the App Store or Google Play — see Section 4.

2. Your License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use one copy of the app on devices you own or control, for as long as your UpliftOS account is in good standing. On Apple devices that license is also subject to the Usage Rules in the Apple Media Services Terms and Conditions.

You may not: copy or redistribute the app, rent, lease, lend, sell, or sublicense it, reverse-engineer, decompile, or disassemble it except where law expressly permits, remove or obscure any proprietary notice, or use it to build a competing product.

3. What the App Asks Your Device For, and Why

The app requests these permissions. Each one is requested when the feature needs it, and declining it disables that feature rather than the app:

  • Camera — capturing evidence, scanning assets, and video on agent calls
  • Microphone — voice commands, voice capture, and agent calls
  • Face ID / biometrics — signing evidence and unlocking your session on the device
  • Photo library — only when you attach an image yourself
  • Location, while in use — attaching geographic context to an evidence capture
  • Speech recognition — transcribing your voice for voice capture and live captions

Biometric data never leaves your device: the operating system tells the app whether it matched you, and nothing more. What we do with the rest is in our Privacy Policy.

4. Paying for Things — Not Through the App Store

The app sells nothing. Where it offers to fund a build, it opens a checkout page in your browser, operated by our payment processor, and that purchase is a transaction between you and UpliftOS under Billing & Credits.

On Apple devices that link appears only on the United States App Store storefront, because Apple's guidelines permit it there and prohibit it on every other storefront. If you do not see it, that is why — the store you installed from is the deciding factor, not where you happen to be.

Because these are not App Store or Google Play transactions, Apple and Google are not the seller, provide no refund, and have no part in the purchase. Refunds are ours to give, under Billing & Credits.

5. Calls, Recordings, and Transcripts

The app can place and join voice and video calls, including calls with AI agents. Calls may be recorded and transcribed where your organization has enabled it. Our obligations and yours around disclosure and consent are in the Outbound Communications Policy — and if you are recording a call with someone else, the law in your jurisdiction may require you to tell them, or to obtain their agreement.

Transcripts are not fed into your organization's shared knowledge unless an administrator has switched that on. It is off by default for every organization, and while it is on, everyone in the organization sees a notice saying so.

6. AI Features

The app surfaces AI agents and AI-generated content. AI output can be wrong, and it is not professional, legal, medical, or financial advice. Check it before you act on it. Our AI Policy and AI Disclosure Policy apply.

7. Acceptable Use

Our Acceptable Use Policy applies to everything you do through the app. In addition, do not use the app to interfere with a device you do not control, to capture recordings, images, or location data of people without the consent the law requires, or to circumvent the platform's access controls.

8. Updates, Availability, and Your Data

We release updates through the App Store and Google Play; some fix security defects, and we may stop supporting older versions. The app needs a network connection for most of what it does, and it is not a backup of anything — your data lives on the platform.

Uninstalling the app removes its local copy from your device. It does not delete your account or your organization's data; for that see Data Rights and Data Retention & Deletion.

9. Ending It

This license ends when your UpliftOS account ends, when you uninstall the app, or if you breach this agreement. On termination, stop using the app and delete it. Sections 2, 10 to 18, and any accrued payment obligations survive.

10. Acknowledgment

This agreement is between you and UpliftOS only, and not with Apple. UpliftOS, not Apple, is solely responsible for the app and its content. This agreement does not provide for usage rules for the app that conflict with the Apple Media Services Terms and Conditions, and in the event of a conflict those Usage Rules prevail.

11. Scope of License

The license granted in Section 2 is limited to a non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules.

12. Maintenance and Support

UpliftOS is solely responsible for providing any maintenance and support for the app, as specified in this agreement or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the app. Reach us at [email protected].

13. Warranty

UpliftOS is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you — and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. The app is distributed free of charge, so that refund amount is zero; any other remedy for a failure to conform is ours, as between you and UpliftOS, and any subscription you hold with us is governed by our Terms of Service rather than by Apple.

14. Product Claims

UpliftOS, and not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of health or fitness frameworks where applicable. This agreement does not limit UpliftOS's liability beyond what applicable law permits.

15. Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, UpliftOS, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

16. Legal Compliance

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.

17. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the app — including your wireless data plan, whose charges are yours.

18. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple will have the right — and is deemed to have accepted the right — to enforce this agreement against you as a third-party beneficiary of it.

19. Google Play

Where you obtained the app from Google Play, the equivalent applies: this agreement is between you and UpliftOS, Google is not a party to it, and Google is not responsible for the app, its content, or any claim relating to it. Your use of Google Play is governed by Google's own terms.

20. Limits, and Contact

Nothing here changes the warranty disclaimers, indemnities, or limitation of liability in our Terms of Service, which apply to the app.
