Outbound Communications Policy
UpliftOS lets you and your agents send email, send SMS, and place AI-assisted voice calls — including to prospects and contacts who have not signed up for UpliftOS. With that power comes legal responsibility. This policy sets the rules you must follow whenever you use UpliftOS to contact anyone outside your own account.
1. Who This Applies To
This policy applies to every outbound message or call generated through UpliftOS — whether sent by you, by a member of your organization, autonomously by an agent you configure, or by an application you build or install (including Marketplace apps). Outbound channels include, without limitation:
- Email (including automated sequences and prospecting/BDR campaigns)
- SMS and other text messaging
- Voice calls, including calls where an AI voice agent speaks with the recipient
- Any other channel UpliftOS adds for contacting third parties
2. You Are the Sender of Record
You — not UpliftOS — are legally responsible for the messages and calls you send. UpliftOS provides the tooling; you decide who to contact, what to say, and on what legal basis. You are responsible for ensuring every outbound communication complies with the laws of the recipient's jurisdiction, including anti-spam, telemarketing, and call-recording laws.
You agree to indemnify UpliftOS against claims arising from communications you send through the platform. See our Terms of Service for the full indemnity.
3. Email & Anti-Spam (CAN-SPAM, CASL, GDPR/ePrivacy)
When you send commercial email — including automated prospecting sequences — you must:
- Use accurate "From," "Reply-To," and subject lines that are not deceptive
- Include a clear, working unsubscribe mechanism in every message
- Honor opt-out requests promptly (within 10 business days under CAN-SPAM) and not re-contact opted-out recipients
- Include a valid physical postal address for the sender
- Where required (e.g., Canada's CASL, the EU/UK), obtain a lawful basis or consent before emailing
UpliftOS maintains suppression lists and unsubscribe handling, but you remain responsible for confirming each campaign is compliant before it runs.
4. SMS & Voice Calls (TCPA and Telemarketing Rules)
Automated and AI-assisted calls and texts carry heightened legal risk. In the United States, the Telephone Consumer Protection Act (TCPA) generally requires prior express consent before placing automated or AI-voice calls or sending marketing texts to a mobile number — with statutory damages of $500–$1,500 per violation.
When using SMS or voice through UpliftOS, you must:
- Obtain and document the consent required for the type of call/text you are making
- Honor STOP / opt-out requests immediately and maintain a do-not-contact list
- Respect calling-time restrictions and national/state do-not-call registries
- Identify yourself (and, where required, your AI agent) at the start of the call
5. Call Recording & Consent
UpliftOS can record and transcribe voice calls. Many U.S. states (California, Florida, Illinois, Pennsylvania, Washington, and others) and many countries require the consent of all parties before a call is recorded.
- You must ensure every participant is notified of recording and, where required, consents before recording begins
- Where UpliftOS plays or displays a recording disclosure, you must not disable or circumvent it
- You are responsible for the lawful storage, retention, and deletion of recordings and transcripts
6. AI Voices and Agents
When an AI agent speaks or writes on your behalf, you may be required to disclose that the recipient is interacting with AI rather than a human (for example, under California's bot-disclosure law and the EU AI Act). See our AI Disclosure Policy for these requirements.
7. Prohibited Outbound Conduct
You may not use UpliftOS outbound channels to:
- Send unlawful spam or contact people who have opted out
- Impersonate a real person or organization, or misrepresent your identity
- Harass, defraud, or deceive recipients
- Contact numbers or addresses obtained unlawfully
- Evade carrier filtering, rate limits, or platform safeguards
Violations may result in suspension or termination under our Acceptable Use Policy.
